Law & Mental Health Professionals: Massachusetts

Law & Mental Health Professionals: Massachusetts Review

Law forms of business practice; insurance reimbursements and deductions for services; privacy of professional information; practice laws related to families, juveniles, civil matters, and criminal matters; and limitations on and liability for practice. The author presents and integrates information from the Massachusetts Constitution, state statutes, regulations of administrative agencies, appellate court decisions, and the Massachusetts Supreme Court to complete this volume. The laws taken from these sources are expressed with minimal legal jargon, making this reference maximally accessible to those outside of the legal profession.

Law Without Enforcement: Integrating Mental Health and Justice

Law Without Enforcement: Integrating Mental Health and Justice Review

Until recently, law relating to mental disorder and to the mentally disorded has rarely been the subject of such extensive and heated debate. This book explores and reflects upon this debate. So far the debate's focus has been on the tension between public protection and individual civil rights, since much of its impetus has derived from notorious homicides in the community and been directed towards calls for a community treatment order. The debate encapsulated here is more comprehensive, going to the heart of the nature of mental illness and its impacts on legal capacity, juxtaposing constructs which arise out of profoundly differing disciplines. The book concludes that the contribution of current mental health legislation is both marginal and it seeks to set an agenda for radical law reform by recognizing that asking questions may, at this stage, be more valuable than providing hasty answers. Many of the chapters deal with the recent Bournewood decision in the House of Lords.

Reconstructing Mental Health Law and Policy (Law in Context)

Reconstructing Mental Health Law and Policy (Law in Context) Review

See more picture

The first title from the 'Law in Context Series' to fully consider the issues surrounding this subject, this text provides a critical and in-depth analysis of the current regime and the tensions within it by examining the development of contemporary mental health law in its social and political context. Dr Glover-Thomas charts the origins of mental health law from the 19th century to the modern health law reform programme including the provisions of the Mental Health Act 1983. The author also addresses the provision of community care and the disillusionment over the use of that policy that has followed. Importantly, the provision for mentally disordered offenders and the use of diversion is examined. Finally, there is a critical analysis of the latest mental health legislation, and some views as to the future of mental health provision in England and Wales. The book is designed to give the reader a better understanding of the law and policy in this field and is directed especially at legal, mental health and related professionals as well as postgraduate students studying mental health law as pa rt of an LLM or those taking postgraduate qualifications in Mental Health Studies. It can also be used as secondary reading for undergraduate students studying medical law.
